Conditions

General terms and conditions 


Accommodation:

 

1. arrival / departure 

 

from 16.00 o'clock until 10.00 o'clock at the latest. Departure must be no later than 10.00 am on the day of departure. Exceeding the departure time by more than 30 minutes will result in the charging of an additional night. Other arrival and departure times can be agreed individually with the landlord. If the tenant does not appear on the day of arrival until 22.00 o'clock, the contract is considered terminated after a period of 48 hours without notification to the landlord. The landlord or his representative can then freely dispose of the object. A (pro rata) refund of the rent due to early departure will not be made in principle. 

 

2. special requests and additional agreements 

 

are generally possible. They require written confirmation by the landlord. In the case of pets, the type and size must be specified. 

 

3. payment 

 

The rental contract becomes valid upon receipt of the down payment to the account of the lessor. The deposit of 25% of the rental amount is due for payment within seven days after receipt of the booking documents. After the deposit has been made, payment of the remaining amount is due 30 days before the start of the trip. If the payment deadlines are not met, the landlord may withdraw from the contract. Non-payment is considered as withdrawal and entitles to re-letting. Additional costs for electricity, water, parking space, waste will not be charged. 

 

4. withdrawal 

 

You can withdraw from the contract at any time. The withdrawal must be in writing. 

In the event of withdrawal, you are obliged to compensate us for the damage incurred: 

 

- from the day of booking confirmation by the landlord until the

  121st day before the beginning of the rental period no compensation 

- from the 120th day until the 91st day before the beginning of the rental period the amount of the deposit 

- from the 90th day to the 61st day before the beginning of the rental 50% of the total price 

- from 60. day to 15. day before beginning of rent 80% of the total price 

 

In case of cancellation less than 15 days before the beginning of the rental period, the full price is payable. The date of receipt of your cancellation notice counts in each case. Amounts already paid will be charged. A substitute person who enters into your contract under the above-mentioned conditions can be provided by you. A written notification is sufficient. 

 

5. obligations of the tenant 

 

The tenant is obliged to treat the rented property (cottage, inventory and outdoor facilities) with care. If damage to the vacation home and / or its inventory occurs during the rental period, the tenant is obliged to report this immediately to the landlady. Defects and damages already detected upon arrival must be reported immediately to the landlady, otherwise the tenant is liable for these damages. A reasonable period of time must be allowed for the rectification of damage and defects. Claims arising from complaints that are not reported immediately on site are excluded. Complaints that are received by the landlord only at the end of the stay or after leaving the vacation home are also excluded from compensation. In the event of any service disruptions, the tenant is obliged to do everything reasonable within the scope of his legal obligation to contribute to the elimination of the disruption and to keep any damage incurred to a minimum. On the day of departure, personal belongings are to be removed by the tenant, household waste is to be disposed of in the designated containers, dishes are to be stored clean and washed in the kitchen cupboards. 

 

6. data protection 

The tenant agrees that in the context of the contract concluded with him necessary data about his person will be stored, changed and / or deleted. All personal data will be treated with absolute confidentiality and will not be disclosed to third parties. 

 

7. liability 

 

The tender has been prepared to the best of our knowledge. For an influence of the renting object by higher force, by country-usual power and water failures and thunderstorms is not liable. Likewise, no liability is accepted in the event of unforeseeable or unavoidable circumstances such as official orders, sudden construction site or for disturbances due to natural and local conditions. However, the lessor will be happy to assist in remedying the problems (as far as this is possible). Any liability of the lessor for the use of the provided equipment is excluded. The arrival and departure of the tenant is his own responsibility and liability. The landlord is not liable for personal belongings in case of theft or fire. The lessee is fully liable for wilful destruction or damage. 
 

8. final provisions 

 

Photos and text on the website or in the flyer are for realistic description. The 100% match with the rental property can not be guaranteed. The lessor reserves the right to make changes to the equipment (e.g. furniture), provided that they are of equal value. Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that comes closest to the economic and legal intent of the contracting parties. Spanish law shall apply. Jurisdiction and place of performance is the place of residence of the lessor.

 

 


Tour Offer & Services:

 

1. pick up or meeting

 

If the client does not show up on the day of the meeting/pick-up up to max. 30 min after the agreed date, the contract is considered cancelled. Canna Holidaze or its representative can then freely dispose of the tour place or service. In principle, there will be no (pro rata) refund of the price. However, a new appointment is possible under certain circumstances.

 

2. special requests 

 

are possible in principle. They require written confirmation by Canna Holidaze. 

 

3. payment 

 

The purchase contract becomes valid upon receipt of the down payment to the account of Canna Holidaze. The down payment of 50% of the purchase amount is due within seven days after receipt of the invoice. After the deposit has been made, payment of the remaining amount is due 30 days before the start of the tour. If the payment deadlines are not met, Canna Holidaze may withdraw from the contract. Non-payment is considered as withdrawal and entitles to reschedule the appointment.

 

4. withdrawal 

 

You can withdraw from the contract at any time. The withdrawal must be made in writing. 

In the event of withdrawal, you are obliged to compensate us for the damage incurred: 

 

- from the day of booking confirmation by Canna Holidaze until 

  the 121st day before the date - no compensation 

- from the 120th day to the 31st day before the date - the amount of the down payment  

- from the 30th day to the 8th day before the appointment - 80% of the total price 

 

In case of cancellation less than eight days before the appointment, the full purchase price is to be paid. The date of receipt of your cancellation message counts in each case. Amounts already paid will be charged. You can provide a substitute person who will join your contract under the above conditions. A written notification is sufficient. 

 

5. obligations of the customer 

 

The customer is obliged to follow the instructions of the guide during the entire tour / service. Complaints received by Canna Holidaze after the tour / service are excluded from compensation. In case of any accidents or other problems that may occur, the Client is obliged to do everything reasonable within the scope of his/her legal obligation to contribute to a remedy / solution and to keep any damage that may have occurred to a minimum.

 

6. data protection 

 

The customer agrees that in the context of the contract concluded with him necessary data about his person will be stored, changed and / or deleted. All personal data will be treated with absolute confidentiality and will not be passed on to third parties. 

 

7. liability 

 

The description of the tour & service offer was created to the best of our knowledge. For an influence of the tour / service by force majeure, by country-usual power and water failures and thunderstorms is not liable. Likewise, no liability is accepted in the event of unforeseeable or unavoidable circumstances such as official orders, sudden construction sites or disruptions due to natural and local conditions. Any liability of Canna Holidaze for the use of the provided equipment is excluded. If no transfer has been added to the tour / service, the arrival and departure of the client is his own responsibility and liability. Canna Holidaze is not liable for personal belongings. The client is fully liable for any destruction or damage during the tour / service. 

 

8. final provisions 

 

Photos and text on the website or in the flyer are for realistic description. The 100% correspondence with the tour offer cannot be guaranteed. Canna Holidaze reserves the right to make changes, provided they are equivalent. Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that comes as close as possible to the economic and legal will of the contracting parties. Spanish law shall apply. Jurisdiction and place of performance is the place of residence of the lessor.

Holidaze Passes & Memberships:

 

1. Payment 

 

Holidaze passes must be paid 100% in advance. As soon as we have received your payment, we will issue your passes and send them to you by e-mail! 

Payment for your membership will be made at the same time as your pass is sent to you.

 

2. cancellation 

 

Cancellations of passes are not possible. As we have already paid your membership fees to the respective CSC's at the moment you receive your passes!

 

3. memberships in the CSC's

Your passports purchased from us are not to be considered as membership in the CSC, but they are your letter of recommendation for the respective CSC's, which in the end decide themselves who they accept and who they don't! If you are rejected by a CSC, you have the possibility to transfer your passport to another CSC!
